Terms & Conditions

All cheques/standing orders/direct debits for advertising should be made payable to Rochdale Online Ltd and sent to Rochdale Online Ltd, 122 Yorkshire Street, Rochdale OL16 1LA.

If payment is by invoice, payment is required within 30 days of date of invoice. Interest at the rate of 5% per annum over the base rate for the time being of Lloyds Bank will be charged on overdue payments and payment of interest shall not prejudice the seller’s rights under any contract.

All order confirmations constitute a legally binding agreement which can only be cancelled by written notice within 7 days of signing. A cancellation fee of 30% of the total cost will be charged.

The Advertiser is responsible for supplying necessary copy and artwork to Rochdale Online Ltd. If all assets required for the production of the advertisement are not received within 30 days of order then Rochdale Online Ltd reserves the right to advertise only the name and address of the Advertiser and the full cost of the advertisement will still be charged.

Where finished artwork supplied by the Advertiser does not meet the Mechanical Data requirements detailed below, then Rochdale Online Ltd reserves the right to re-charge any additional production costs required. Wherever possible, the advertiser will be informed prior to publication.

Rochdale Online Ltd will make best endeavours to meet the Advertisers’ requirement for preferred positioning but retains the final decision on such positioning.

Rochdale Online Ltd does not accept liability for delays in publication and it is hereby agreed that delays in publication will not constitute a breach of contract.

No variation of these conditions shall be binding unless agreed in writing by a Director or person designated by Rochdale Online Ltd.

No responsibility can be accepted for damage to, or loss of artwork or any other supplied material.

Rochdale Online Ltd reserves the right to refuse any advertisement which it deems to be unsuitable for publication and shall not be liable for failure of an advertisement to appear for any cause whatsoever.

All advertisements are accepted on the sole understanding that any descriptions relating to goods or services do not contravene the provisions of Trade Descriptions Act 1968.

The client indemnifies Rochdale Online Ltd in respect of any claims made against Rochdale Online Ltd arising from the development and the content of the advert.

Rochdale Online Ltd assumes no responsibility for errors or omissions in the information or other documents on the client's web sites. In no event shall Rochdale Online Ltd be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever including without limitation, those resulting from:

  1. Reliance on the materials presented
  2. Costs of replacement goods
  3. Loss of use, data, turnover, sales revenue or profits
  4. Delays or business interruptions
  5. Any theory of liability, arising out of or in connection with the use or performance of the web page/s whether or not Rochdale Online have been advised of the possibility of such damages.

You are entirely responsible for the content of your advert. The following content may not be on any advert:

  1. Copyrighted material, unless the owner has granted consent.
  2. Unlawful content which violates any law, regulation, or order. This includes, but is not limited to: obscene or pornographic material; defamatory, fraudulent, or deceptive statements; threatening, intimidating or harassing statements.
  3. Indecent or objectionable content including both pornographic and verbal obscenities which, even if lawful, Rochdale Online may, at its sole discretion, deem harmful to the Rochdale Online reputation and brand image.
  4. Warez links.

Links and any information regarding how to obtain access to the above will also be regarded as in violation of this condition.

You are responsible for any misuse, even if a friend, family member, guest or employee has committed the inappropriate activity. Therefore, you must take steps to ensure only authorised personnel gain access.

You agree to keep secure any ID and password provided to access your account on Ask Rossendale web site.

Violation of any of these terms and conditions may result in the client's advert being removed without reimbursement and their listing on the Ask Rossendale web site suspended.

You shall pay the charges (without any set off or deduction of any kind) on either a monthly or annual basis (subject to the agreed minimum contract term).

All amounts payable by you shall be exclusive of Value Added Tax ("VAT"), or any other applicable tax or duty, which shall be payable in addition to all such amounts due from you.

You agree that you will notify us as soon as possible of any change in your credit/debit card or bank account details. Should you terminate the service, it is your responsibility to terminate any standing order/direct debit with your bank.

We may increase the amount payable for the service at our discretion.

Refund Policy

Should you change your mind within 7 days we will refund your payment (providing your order has not been completed). THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CUSTOMER.

Privacy Policy

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

By law we have to keep basic information about our customers (including contact, identity, financial and transaction information) for six years after they cease being customers for tax purposes.

We may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Where we rely on your consent to use your personal information, you have the right to withdraw that consent at any time. This includes the right to ask us to stop using your personal information for direct marketing purposes or to be unsubscribed from our email list at any time. You also have the following rights:

(1) Right to be informed – you have the right to be told how your personal information will be used. This Policy and other policies and statements used on our website and in our communications are intended to provide you with a clear and transparent description of how your personal information may be used.
(2) Right of access – you can write to us to ask for confirmation of what information we hold on you and to request a copy of that information. Provided we are satisfied that you are entitled to see the information requested and we have successfully confirmed your identity, we have 30 days to comply.
(3) Right of erasure – as from 25 May 2018, you can ask us for your personal information to be deleted from our records. In many cases we would propose to suppress further communications with you, rather than delete it.
(4) Right of rectification – if you believe our records of your personal information are inaccurate, you have the right to ask for those records to be updated.
(5) Right to restrict processing – you have the right to ask for processing of your personal data to be restricted if there is disagreement about its accuracy or legitimate usage.
(6) Right to data portability – to the extent required by the General Data Protection Regulations (“GDPR”) where we are processing your personal information (i) under your consent, (ii) because such processing is necessary for the performance of a contract to which you are party or to take steps at your request prior to entering into a contact or (iii) by automated means, you may ask us to provide it to you – or another service provider – in a machine-readable format.

Where we consider that the information with which you have provided us does not enable us to identify the personal information in question, we may ask you for (i) personal identification and/or (ii) further information.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
